Offense of Judges! Councillor and Lawyer Claus Plantiko from Bonn is on Trial

Vielen Justizgeschädigten ist er bekannt: Der Bonner Rechtsanwalt Claus Plantiko.

Er musste sich am 08.12.2006 am Amtsgericht Bonn wegen des Vorwurfs der Richterbeleidigung verantworten.

Many claimants of the justice know him: The lawyer Claus Plantiko from Bonn. On 8^th of December 2006 he had to answer for pretended offending of judges at the local court (Amtsgericht) of Bonn.

Der Rechtsanwalt und Bonner Kommunalpolitiker wurde im Gerichtssaal von den Prozessbeobachtern mit weißen Rosen, dem Symbol des gewaltlosen Widerstandes, und mit Beifall empfangen.

The lawyer and local politician of Bonn has been welcomed by the case observers in the courtroom, with white roses, the symbol of non violent resistance, and with applause.

Der RA Plantiko habe den Richtern "Verfassungshochverrat im Amt" und "Rechtsbeugung" vorgeworfen, so die Anklage. Außerdem habe er das Gericht mit "Hitlers und Stalins Ausnahmegerichtsbarkeit" verglichen.

Lawyer Plantiko would have accused the judges for „High Treason of the Constitution in Office” and “Perversion of Justice”, so the posecution. Furthermore he would have likened the court to “Hitler´s and Stalin´s Exceptional Judication”.

Plantiko entschuldigte sich mit der Auffassung, er habe keinen Richter persönlich beleidigen wollen, sondern nach seiner Ansicht nur "die Wahrheit" gesagt, da es in Deutschland keine Volkshoheit und Gewaltentrennung gäbe.

Plantiko apologized by the statement, he hadn´t intentioned to offend any judge in personal, but he would have said only “the truth”, because there where neither popular sovereignty nor separation of power in Germany.

Das Amtsgericht fand, "die Grenzen seien überschritten" und verurteilte den streitbaren Anwalt wegen Richterbeleidigung in insgesamt sieben Fällen zu 18 000 Euro Geldstrafe.

The local court meant „the limits would have been crossed“ an sentenced the

disputatious lawyer to  a penalty of 18.000 Euro because of offending judges in seven cases altogether.

Im Publikum gab es Protest gegen das Urteil. Justizkritiker meinten, der Weg zu einem funktionierenden Rechtsstaat müsse erst gegangen werden und kündigten weitere Aktivitäten an.

From the public here was protest against the conviction. Critics of justice meant the way to a working constitutional state would have to be gone at first yet and announced further activities.

"Die Gesetze wegen Beleidigung gibt es in einigen europäischen Ländern nicht mehr. Sie kommen aus einem infantilen Ehrenkult", meinte ein Prozessbeobachter. "Wer souverän ist, kann sich von solchen Worten nicht beleidigt fühlen." Aber offenbar habe Beleidigung für Richter eine unendliche Halbwertzeit.

“The laws concerning offending are not existing any more in some European countries. Their origine is an infantile cult of honour”, meant a case observer.

Wird in Deutschland gewaltloser, verbaler Widerstand kriminalisiert? Der Münchner Rechtsanwalt Rolf Bossi wurde am 04.12.2006 auch zu einer Geldstrafe von 12 000 Euro verurteilt. Er habe in einer Gerichtsverhandlung das Wort "Richterkumpanei" benutzt.

Get´s  non violent, verbal resistance criminalized in Germany? The lawyer Rolf Bossi, Munich, has been sentenced to a penalty of 12.000 Euro on 4^th of December 2006. He would have used the word “fellowship of judges”.
